Brothel Customer Granted Bail in Pocso Case
A 25-year-old man from Udupi district gets bail in a Pocso case, with the court noting his status as a brothel customer.

The Karnataka High Court on August 10 granted bail to a 25-year-old man from Karkala in Udupi district, citing his status as a brothel customer. Justice S Rachaiah observed that it was not possible for him to know the actual age and caste of the survivor. The court directed him to furnish a personal bond of Rs 1 lakh and appear before the trial court on all hearing dates. He was also instructed not to commit any similar offence or threaten any prosecution witnesses.
The incident allegedly took place between December 24 and 2, 2025, when the girl was kept at a house in Mangaluru and told to cooperate with 'customers'. Her father was also allegedly involved. The girl informed her uncle and aunt upon returning to Birur, who then lodged a complaint under various provisions of the Bharatiya Nyaya Sanhita, 2023, the Protection of Children from Sexual Offences (Pocso) Act, 2012, Immoral Traffic (Prevention) Act, 1956, Juvenile Justice Act, 1986, and the SC & ST (Prevention of Atrocities) Amendment Act, 2015.
Following the registration of the case, the petitioner was arrested. A sessions court rejected his bail plea on March 25, after which he approached the high court. The petitioner, arraigned as accused no. 2, claimed he was merely a customer and was unaware of the survivor’s age. He also claimed he did not know that she belonged to an SC community.
The court’s decision highlights the complexities of legal interpretations in cases involving child protection laws. The petitioner’s argument that his status as a customer made it impossible for him to know the survivor’s age and caste was a key point in his bail petition. The high court’s ruling underscores the legal challenges in such cases, where the intent and knowledge of the accused are critical factors.
The case has sparked discussions about the enforcement of Pocso and other child protection laws. Legal experts have noted that while the court’s decision may provide some relief to the accused, it also raises questions about the effectiveness of these laws in preventing exploitation. The case also brings to light the role of family members in such incidents, as the girl’s father was allegedly involved in the alleged activities.
The legal proceedings continue as the petitioner is required to comply with the court’s directives. The case serves as a reminder of the importance of stringent enforcement of child protection laws and the need for awareness and education to prevent such incidents. The outcome of the trial will be crucial in determining the legal consequences for the accused and in shaping future approaches to similar cases.
